1. Introduction

1.1 These General Terms and Conditions (“Terms”) govern your use of the SLOMADE website (www.slomade.eu) and any related services, applications, or platforms (collectively, the “Platform”) operated by MaxiNet, spletne rešitve, Darja Vogelnik, s.p., located at Balos 9, 4290 Tržič, Slovenia, business registration number: 9731032000  (“SLOMADE”, “we”, “us”, or “our”).

1.2 By accessing or using the Platform, you (“User”, “you”, or “your”) agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform.

1.3 These Terms apply to all users of the Platform, including but not limited to customers (“Buyers”), Slovenian creators and Vendors (“Vendors”), and general visitors.

2. About SLOMADE

2.1 SLOMADE is a curated online marketplace that connects Slovenian creators and makers with Buyers worldwide.

2.2 SLOMADE acts as an intermediary that facilitates transactions between Vendors and Buyers by providing a Platform. The legal contract of sale is formed directly between the Buyer and the Vendor. SLOMADE is not the seller or the buyer of the listed products.

2.3 While we strive to ensure a high-quality user experience, we do not assume liability for the quality, legality, accuracy, or delivery of the products offered by Vendors. Vendors are solely responsible for their listings and sales.

3. User Accounts

3.1 You may need to register an account to use certain features of the Platform. You agree to provide accurate, current, and complete information and to keep your account credentials secure.

3.2 You are fully responsible for activities under your account. Notify us immediately if you suspect unauthorized use.

3.3 We reserve the right to suspend or terminate your account if you violate these Terms or provide false or misleading information.

4. Buying Products

4.1 When purchasing a product, you enter into a direct contract with the respective Vendor. Vendors are responsible for their product descriptions, pricing, and shipping policies.

4.2 All applicable consumer protection laws, including the EU right of withdrawal (14 days from delivery), apply where relevant. Vendors must comply with these laws.

4.3 Prices may exclude VAT if the Vendor is not VAT registered. For Vendors who are VAT registered, prices displayed on product pages include VAT, clearly marked with “(VAT incl.)”. VAT is also calculated and added to the total at checkout.

4.4 Payment is processed via third-party providers (e.g., Stripe). SLOMADE is not liable for any issues arising from payment processing services.

5. Returns and Withdrawal Policy

This policy applies to all purchases made via the SLOMADE platform and is in accordance with the Slovenian Consumer Protection Act (ZVPot-1) and EU Directive 2011/83/EU. Return terms are also stated in the description of each individual product.

5.1 Right of Withdrawal
The customer may withdraw from the contract within 14 days of receiving the goods without giving any reason. Withdrawal must be exercised by sending a notification to info@slomade.eu. Upon receipt of the notice, SLOMADE will inform the relevant vendor and provide the customer with return instructions.

5.2 Refund of Payments and Delivery Costs
In the event of withdrawal, the customer will be refunded the full amount paid, including the cost of the cheapest delivery option offered. If the customer chose a more expensive delivery method, the difference will not be refunded. The cost of returning the goods is borne by the customer.

5.3 Return Conditions and Exceptions
Goods must be returned to the vendor within 14 days of withdrawal, undamaged, and in a condition that does not exceed normal handling as would be allowed in a physical store. The customer is liable for any reduction in the value of the goods caused by use or damage.
The right of withdrawal does not apply to goods made to the customer’s specifications, perishable goods, sealed goods not suitable for return for health or hygiene reasons (if the seal has been broken), and other exceptions under ZVPot-1.

In case of defects or warranty claims, the customer should contact info@slomade.eu for further instructions.

6. Selling Products (Vendors)

6.1 Vendors are responsible for ensuring that they are legally entitled to sell listed products, that all descriptions are accurate, and that their business complies with applicable laws, including consumer and tax regulations.

6.2 Vendors authorize SLOMADE, acting as an intermediary, to inform Buyers of their legal rights, including the right of withdrawal under EU law, and to manage returns on their behalf. Vendors agree to cooperate with the return process within the legally prescribed deadlines.

6.3 Vendors authorize SLOMADE to collect payments on their behalf and to issue invoices to Buyers in their name and for their account through the Platform. SLOMADE shall issue to Vendors an invoice for the agreed commission and applicable service fees (including shipping costs advanced by SLOMADE, if applicable). The remaining sales proceeds shall be transferred to Vendors after deducting these amounts.

6.4 SLOMADE charges a commission and applicable fees as outlined in the Vendor Agreement or the current Fee Schedule.

6.5 We reserve the right to remove listings that violate these Terms or applicable laws.

7. Intellectual Property

7.1 The Platform and its content (excluding Vendor content) are the intellectual property of SLOMADE. You may not copy, reuse, or distribute this content without permission.

7.2 Vendors retain ownership of their product images, texts, and other intellectual property, but grant SLOMADE a non-exclusive, royalty-free, worldwide license to use it for promotion and listing.

7.3 You agree not to scrape, copy, or use listings for commercial purposes without express permission.

8. User Content

8.1 Users may post reviews or comments. By doing so, you grant us a non-exclusive, perpetual, worldwide license to use, display, and distribute this content.

8.2 You are responsible for your submitted content and must ensure it is not unlawful, offensive, or infringing.

8.3 We reserve the right to remove content that violates these Terms or applicable laws.

9. Prohibited Conduct

9.1 You may not:

Violate laws or third-party rights;

Upload harmful, misleading, or defamatory content;

Impersonate another individual or entity;

Interfere with the operation of the Platform;

Use the Platform for phishing, spamming, or illegal purposes.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, SLOMADE shall not be liable for indirect, incidental, or consequential damages.

10.2 Our total liability shall not exceed the amount paid by you to SLOMADE in the 12 months prior to the event giving rise to the claim.

10.3 The Platform is provided “as is” without warranties of any kind.

10.4 We are not liable for the acts or omissions of Buyers, Vendors, or payment processors.

11. Indemnification

11.1 You agree to indemnify and hold harmless SLOMADE from claims arising from your breach of these Terms or use of the Platform.

12. Termination

12.1 We may suspend or terminate access to your account at any time, especially if you breach these Terms.

12.2 Certain sections of these Terms will survive termination, including those on intellectual property, liability, and dispute resolution.

13. Governing Law and Dispute Resolution

13.1 These Terms are governed by Slovenian law.

13.2 Any disputes shall be resolved in the competent courts of Ljubljana, Slovenia. Consumers in the EU may also use the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr/

14. Changes to These Terms

14.1 We reserve the right to change these Terms at any time. Updated Terms will be posted on the Platform with the effective date.

14.2 Your continued use of the Platform signifies acceptance of any changes.

15. Entire Agreement

15.1 These Terms constitute the entire agreement between you and SLOMADE regarding the Platform.

16. Website Accessibility

16.1 SLOMADE is committed to providing accessible content for all users, including individuals with various disabilities. The website includes features such as text enlargement, high-contrast mode, and other tools that enhance the user experience. 17. Giveaways

17.1 SLOMADE occasionally organizes giveaways on social media platforms (Instagram, Facebook). The organizer of each giveaway is MaxiNet, Darja Vogelnik s.p., the owner and operator of the SLOMADE platform.

17.2 The rules of each giveaway are published directly in the relevant post and are considered the official rules of the giveaway. Participation is limited to persons who meet the conditions stated in the post (EU residents, 18+).

17.3 Winners will be selected and notified according to the instructions in the respective post. Prizes cannot be exchanged for cash.

17.4 Giveaways are in no way sponsored, endorsed, or administered by the social media platform. All responsibilities related to the giveaways lie solely with the organizer.
